The most glaring of this falsehood was the declaration of President Buhari not only as the winner of that election but, as Obasanjo warned, as the winner by an even bigger majority than he had when he was so much more popular in 2015.  Between 2015 and 2019, President Buhari and the APC had become a major embarrassment and disappointment.  Obasanjo himself was one of their chief supporters in 2015.  But Buhari’s dismal performance in office had led him and many others to the conclusion that Nigeria would be far better off without him.

Under the circumstances, I, for one, predicted time and again that the only way President Buhari could win in 2019 was by massively rigging the vote.  Let’s face it, the wheel of politics cannot be re-invented in Nigeria.  A bad government can only expect to get a comeuppance at the polls.  Bad governments don’t get re-elected in free and fair elections.  That magic only takes place when the votes are rigged.

Therefore, the courts should have the courage to throw President Buhari out of office and declare Atiku Abubakar outright as Nigeria’s president–elect.

Atiku in his petition specifically asked the tribunal to disqualify Buhari, winner of the February 23 presidential election, on the grounds that he (Buhari) did not possess the requisite academic qualification to contest for the office of the President.

The petition, which is premised on five grounds, alleged that Buhari lied about his academic qualification as well as schools attended in his form 001 submitted to INEC for purpose of contesting the 2019 presidential election.

Atiku and PDP had filed their petition against the outcome of the election at the Presidential Election Petition Tribunal in Abuja, on March 18, 2019.

While the HDP and Owuru’s petition marked CA/EPT/PRE/001/2019, was filed March 7, the petition of the C4C along with its presidential candidate and that of the PDM and its presidential candidate were filed same day, March 19, 2019.

However, a statement by the Media Officer of the Court of Appeal, Saadatu Musa Kachalla, on Tuesday said that the “Presidential Election Petition Tribunal Panel will begin its inaugural session on Wednesday, 8th May 2019 at the Abuja Division courtroom. Time: 9a.m.”

While Atiku and the PDP in their petition specifically attacked the conduct of the February 23, presidential election conducted by the Independent National Electoral Commission (INEC), they asked the tribunal to disqualify Buhari on the grounds that he was not qualified to have contested the election in the first place and as such all votes accredited to him by INEC should be declared as wasted votes.

The bill contradicts provisions of the constitution which limits the power of the National Assembly to make laws in relation to water from sources affecting more than one state of inland waterways which has been declared to be an international waterway or inter-state waterway.

“The bill as currently drafted subject the Ministry of Water Resources, the Ministry of Environment and Nigeria Ports Authority to the supervision of the Nigeria Inland Waterways Authority.

“The funding provision of the bill which seeks to appropriate 25 per cent of the ports development levy annually, 15 per cent of the ecological fund annually and 1 per cent of the funds accruable to the federal government for oil and gas within the cleared waterways and the right of way and 2.5 per cent fees annually paid by companies operating power plants within waterways are grossly excessive and will negatively affect the revenues of the federal government”.

Meanwhile, Enang declined to speak on the invitation by the House of Representatives, asking Buhari to appear before it over the rising security issues in the country.

The House on April 11, summoned Buhari to appear “within 48 hours” to address lawmakers on the frequent attacks by herdsmen and other security problems like banditry and kidnappings in the country.

The resolution followed a motion moved by the lawmaker representing Gwer-East/Gwer-West Federal Constituency in Benue State, Mr Terseer Mark-Gbillah.

The resolution, which was unanimous, stated, “Request that the President and Commander-in-Chief of the Armed Forces to address the House and the entire nation within 48 hours.”

His statement had read:

“My Lords we pray the court to set aside the judgments of the Court of Appeal and restore the majority judgment given in his client’s favor by the election tribunal,’’

However, Chief Wole Olanipekun urged the court to ignore Adeleke’s request by affirming the judgment of the Court of Appeal. The Counsel for the Independent National Electoral Commission (INEC) and the APC, consequently supported Olanipekun’s submission, and prayed the court to dismiss the appeal.

The  request made by Adeleke to declare the supplementary election void had been rejected by both courts, Ikpeazu had said INEC lacked the powers to have canceled elections in some pooling units and order a rerun.

He subsequently argued that supplementary election was not not needed because his client had fulfilled all constitutional requirement to be declared the winner of the election. He sited paragraph 44 of the INEC’s Guideline, on which basis the supplementary election was held, as according to him is in conflict with the Constitution.

The Osun State Governorship Election Tribunal had on March 22 declared the PDP candidate as the duly-elected governor of the state, thereby setting aside Oyetola’s victory at the poll. The tribunal held that the cancellation of results from seven polling stations across the state resulting in the conduct of the supplementary election by the Independent National Electoral Commission, INEC violated the Constitution.

The state election tribunal therefore directed the electoral body to withdraw the Certificate of Return earlier issued to Oyetola and issue same to Adeleke. Dissatisfied with the decision, Oyetola, APC and INEC approached the Court of Appeal in Abuja with separate appeals challenging Adeleke’s declaration as governor by the tribunal. The appellate went ahead to upturn the decision of the tribunal in a judgment on May 9 which re-affirmed Oyetola’s victory as governor of the state. At the public forum attended by a wide range of political leaders, diplomats and professionals, Falana lamented that the country’s senior public officers had substituted the rule of law for “the rule of the rulers,” thereby asking the Nigerian masses “to take their destiny in their own hands.”

Specifically, the human rights lawyer cited Buhari’s records of respecting the rule of law, which according to him, had worsened since his heydays as a military dictator.

In a comprehensive analysis of the two administration, Falana said the irony of such official impunity “is that whereas the Buhari military junta released detainees from custody on the orders of the courts.”

He decried worsening cases of violence, banditry and insurgency, which he said, had become prevalent since the president returned to power in 2015.

He, therefore, concluded that under the the Buhari administration, Nigeria had become a banana republic, saying the president’s human rights record “is worse than when Buhari was a military dictator.”

He, equally, lamented Buhari’s poor record of obeying the rule of law, wondering that president claimed to be a converted democrat, though the claim had been disputed by the refusal of his administration to comply with the orders made by several courts for the release of a number of citizens from unlawful custody.

Apart from treating the orders of the courts with contempt, Falana said Buhari, currently the Chairman of the Economic Community of West African States (ECOWAS), had ignored the orders of the Community Court of Justice with respect to the restoration of the civil liberties of Nigerian citizens.

Incidentally, the EFCC has filed a detailed response against the judge’s restraining order and took up issues over the controversial interim order.

While waiting for the careful response of the CJ over the Commission's request, we wish to advise ex-Senate President to carry his cross and allow the judiciary to performs its constitutional role.

It is preposterous for the ex-Senate President to be raising issues on what transpired during the confirmation of EFCC boss in 2016 when he is no longer in charge of the Senate in 2019.

It is too late for him in the day, to be claiming innocence over the confirmation saga when every Nigerian knew what transpired under his watch.

The Commission under Magu, has moved on and will not be distracted over mundane issue.

Let it be stated in unequivocal terms that the investigation of Saraki’s stewardship, whether as a former Senate President or as a former governor of Kwara State, has absolutely nothing to do with the non-confirmation of Mr. Ibrahim Magu as the substantive Chairman of the EFCC.

While the EFCC will not allow itself to be drawn by Saraki to take up issues with him on the pages of newspapers, it is pertinent to once again state in clear terms that the probes being carried out by the EFCC are nothing personal, but all about enthroning probity in governance, and letting leaders know that even out of office, they will be held accountable for their stewardship.

Again, it is worth reminding Saraki that he has no need to be scared of the EFCC and its leadership as long as he believes he has a clear conscience.

He should, therefore, rather than running from pillar to post, allow the law to take its course.
